Terms of Use
These terms govern your use of AwakeKt Studio ("Studio") on any platform and the Awake Cloud service that supports it, both provided by AwakeKt ("we", "us"). By using Studio you agree to them. Our Privacy Policy explains how we handle personal data.
1. Early-access software
Studio is in alpha. Features change, and bugs can cause data loss. Keep backups of work you care about, for example with File › Export Project (.zip).
2. Your content
You own the projects, scenes and assets you create. We claim no rights to them, and unless you publish them they stay on your device and we do not see them. You are responsible for having the rights to anything you import or publish.
When you publish a project to Awake Cloud, you give us a worldwide, non-exclusive, royalty-free licence to store, copy and serve it, and to show its name, description and thumbnail, only as needed to run Awake Cloud. For a public project, you also let anyone use Studio or the web player to find, download, open and play it. This licence ends when you delete the project or your account, except for copies others already downloaded.
3. Your account
You need an Awake Cloud account only to publish or report projects. Keep your sign-in details to yourself; you are responsible for what is done with your account. You must be at least 13, or older where your country requires it. You can delete your account and everything you published at any time from the account menu in Studio; see how to delete your account.
4. Publishing rules and reports
Don't publish anything that:
- breaks the law, or infringes someone else's copyright, trademark, privacy or other rights;
- sexualises minors, or is sexually explicit;
- promotes violence, terrorism, self-harm, or hatred against people for who they are;
- harasses, threatens or impersonates anyone, or shares someone's personal information;
- contains malware, or tries to harm players, devices or our services;
- is spam or misleading.
Anyone signed in can report a public project from its card in Studio. We review reports and may hide or remove a project, and suspend or delete an account, that breaks these rules, with or without notice. Tell us at [email protected] if you think we got it wrong, or to report something urgent.
A hidden project disappears from Awake Cloud for everyone else, but you still see it in My Projects, marked Hidden. Publishing it again doesn't unhide it.
5. Licences
Studio's source code is licensed under the GNU Affero General Public License v3.0, or a commercial licence from AwakeKt. The Awake engine it builds on is licensed under Apache 2.0. Nothing in these terms limits the rights those licences give you. The AwakeKt name and marks are not licensed for other use.
6. Studio Pro subscriptions
- Studio Pro is a paid subscription. You can buy it on studio.awakekt.com through our authorized payment partner or merchant of record shown at checkout (such as Paymentwall or Lemon Squeezy), or through an app store. Either way it renews automatically until you cancel, and you keep it until the end of the period you paid for.
- On the web, our payment partner bills you and sends your receipt; cancel from your account, from the link in your receipt, or by emailing us. Refunds follow our refund policy.
- Through an app store, the store bills you, renews the subscription automatically until you cancel, and handles refunds under its own policy. Cancel or manage it in the store's subscription settings.
- Any free trial is described at purchase. Unless you cancel before the trial ends, you will start being charged.
- Studio checks your subscription with Awake Cloud when it starts, and each check is valid for up to 24 hours. If Studio can't check, for example because you're offline, it runs with its free features until it can verify again.
- What Pro includes is listed where you buy it. We may improve or change Pro features; if we remove a major feature you paid for, you can cancel where you bought it.
7. Acceptable use
Don't use Studio or Awake Cloud to break the law, infringe others' rights, distribute malware, attack or overload our services, or get around subscription checks.
8. Availability
We try to keep Awake Cloud available but don't guarantee it. We may suspend or end the service or your access if you break these terms or to protect the service.
9. Disclaimers and liability
Studio is provided "as is", without warranties of any kind, to the extent the law allows. To the extent the law allows, AwakeKt is not liable for indirect or consequential losses, or for lost data or profits. Our total liability for any claim is limited to what you paid for Studio Pro in the 12 months before it arose. Nothing here limits rights you have under consumer law that cannot be waived.
10. Governing law
These terms are governed by the laws of the Republic of the Philippines, and its courts have jurisdiction, unless the consumer law of your country gives you the right to bring claims where you live.
11. Changes
We will post changes here with a new effective date. For material changes we will also give notice in the app or another reasonable way before they take effect. Continuing to use Studio after that means you accept the new terms.
